Goods for sale on the T.O.F. website
All the goods for sale are described in good faith and to the best of our abilities.
T.O.F. cannot be held responsible for bad appreciation of color, size or shape of the items displayed on the site. Offers and prices are applicable upon visiting the site. They can be amended at any given time without prior notice. Availability of the items are for information only, in order to facilitate orders. It may happen that an item labelled as "available" on the site is not in stock. T.O.F. will then refund or exchange this item.
T.O.F. cannot be held responsible for any damage caused by unavailability of an item. Prices are in Euros, inclusive VAT but exclusive shipping costs.
Contract with T.O.F.
A valid contract is concluded between T.O.F. and yourself when T.O.F. receives confirmation of your order on its site. T.O.F. may however decide to end the contract in the absence of payment within the month following your order.
Order
Products "in stock" are shipped at the latest 24 h after placing you order. If the order contains one or several products requiring a longer delay, delivery of the total order will be put on hold until we receive the goods from the manufacturer. In this case, please allow 5 to 8 days for delivery. Our system has integrated stock management software. Despite all our efforts, it may happen that a product tagged as "available", is out of stock. In this case, we will contact you and discuss the best possible solution for you.
If it appears that one or several products is no longer available, you will be advised by phone or email. You will have the option to change your order or receive a refund for the missing products. All refunds will be executed by bank transfer.
Returns
The Belgian law on commerce, information and consumer protection of April 06th 2010 allows the buyer to notify the seller that he/she wishes to cancel the purchase and return the goods within 14 working days after purchase or delivery.
You may choose to cancel your order in the order history of the website as long as it has not been paid or shipped. If you wish to cancel your purchase after receiving the goods, you are required to notify us and to return the (non-opened) items within 7 working days after reception. We will refund you as soon as we collect the returned goods. Return shipping costs are to be paid by the buyer..
Delivery
Parcels are delivered by Bpost (Belgian Postal Services) or one of his sub-contractors. Delivery takes 1 day for Belgium, 3 to 4 (week) days for the neighbouring countries. For all other countries, please allow 3 to 7 days depending on your location, after placing your order.
For customers outside Europe, any order may be subject to import taxes and customs fees. The customer must first ensure that the products ordered do not contravene the laws of the country of the recipient. Delivery times outside EU are never guaranteed due in particular to customs control.
The goods are delivered at the address entered when ordering. T.O.F. cannot be held accountable for any delays due to strickes, postal problems, weather conditions, etc.
Warranty
All items for sale on our website are covered by a warranty against production defaults. This warranty does not cover damage caused by abusive use or different from what is prescribed by the manufacturer, normal wear of the product, shocks, blows or bad handling. Even if the product is covered by a lifetime warranty, fees are applied for shipping and handling. The amount of these fees vary from suplier to suppleir.The warranty does not cover shipping to our customer service. The invoice acts as warranty document and must be presented prior to any intervention. Small items and consumables are not covered by warranty.
If the purchased item is not what you ordered or if it is damaged, please return it. We will replace or refund your order as well your shipping costs.
Waiver and limited responsibility
T.O.F. does not guarantee that tof-fyfishing.com will not suffer any interruptions or will be error-free.
T.O.F. does not guarantee any achievements resulting from the use of tof.flyfishing.com nor the accuracy or liability of information provided by tof-flyfishing.com.
T.O.F. is not committed or does not guarantee expressly or implicitly the proper functioning of the website in terms of information, content, articles and items displayed.
Intellectual property
All elements present on our website are protected by copyright, trademark, patent. Copying, reproduction, posting, transfer, faxing or downloading is prohibited without prior consent.
Applicable law and competent jurisdiction
Belgian law applies exclusively. Judicial district of Nivelles will be competent.
